Terms of Service

These Terms of Service ("Terms") govern your use of The Pool desktop application and related services (collectively, the "Service") provided by Pool Games, LLC, a California limited liability company ("we," "us," or "our"). By downloading, installing, or using the Service, you agree to these Terms.
1. Description of Service
The Pool is a single-player desktop poker simulation application for Windows. It generates simulated low-stakes cash game sessions against computer-controlled opponents (NPCs) for the purpose of practice and hand data generation. The Pool is not an online poker site and does not involve real-money wagering of any kind.
2. Eligibility
You must be at least 18 years of age to use the Service. By agreeing to these Terms, you represent that you are at least 18 years old.
3. Account and License
Access to the Service requires a valid subscription and license key. Each license key permits activation on one (1) device at a time. You may not share, resell, sublicense, or transfer your license key to another person. We reserve the right to revoke license keys that violate these Terms.
4. Subscription and Payment
The Service is offered on a monthly subscription basis. Payment is processed through our third-party payment provider, LemonSqueezy. By subscribing, you also agree to LemonSqueezy's terms of service. Subscriptions renew automatically each billing cycle until canceled. You may cancel at any time through your LemonSqueezy account; cancellation takes effect at the end of the current billing period.
5. No Real-Money Gambling
The Pool is a simulation. All in-game currency, bankrolls, and transactions are entirely simulated and have no real-world monetary value. Nothing within the Service constitutes gambling, wagering, or any exchange of real money between players.
6. Data and Exports
All game data generated during your sessions — including hand histories, NPC behavioral metadata, and session reports — is stored locally on your device. You own your exported data and may use it however you choose. We do not access, collect, or transmit your game data.
7. Intellectual Property
The Service, including its NPC decision engine, behavioral models, scoring systems, user interface, and all associated code and assets, is the proprietary property of Pool Games, LLC and is protected by copyright and trade secret law. You may not reverse-engineer, decompile, disassemble, or attempt to extract the source code of the Service. You may not copy, modify, distribute, or create derivative works based on the Service.
8. Acceptable Use
You agree not to:
- Circumvent, disable, or interfere with any security or licensing features of the Service
- Use the Service for any unlawful purpose
- Redistribute, publicly display, or commercially exploit the Service or any of its components
- Attempt to access the Service's internal systems, APIs, or databases beyond what is provided through normal use
9. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that it will meet your specific requirements. We make no guarantees regarding improvement of your poker skills or results in any real-money poker environment.
10. Limitation of Liability
To the maximum extent permitted by law, Pool Games, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim arising from these Terms shall not exceed the amount you paid for the Service in the twelve (12) months preceding the claim.
11. Termination
We may suspend or terminate your access to the Service at any time if you violate these Terms. Upon termination, your license is revoked and you must uninstall the Service. Sections 7, 9, 10, and 12 survive termination.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in Los Angeles County, California.
13. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you through the Service or by email. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
